1. General Information
These Terms govern access to and use of the website www.shoppingmalldova.md, hereinafter referred to as the “Website” or the “Site”.
The Website is owned and operated by “Lemi Invest” S.R.L., located at 21 Arborilor St., Chisinau Municipality, Republic of Moldova, hereinafter referred to as “Shopping MallDova”, the “Company” or “we”.
By accessing, browsing or using the Website, the user confirms that they have read, understood and accepted these Terms. If you do not agree with these rules, you must stop using the Website.
These Terms are supplemented by:
- the Privacy Policy available on the Website;
- the Cookie Policy available on the Website;
- specific rules for individual campaigns, events or activities, if published separately on the Website.
In the event of any inconsistency between these Terms and the specific rules applicable to a particular campaign or event, the specific rules shall prevail solely with respect to the relevant campaign or event.
2. Definitions
For the purposes of this document, the terms below shall have the following meanings:
Shopping MallDova / Company — Î.C.S. “Lemi Invest” S.R.L., located at 21 Arborilor St., Chisinau Municipality, Republic of Moldova.
Website / Site — the online platform available at www.shoppingmalldova.md, through which users may obtain information about the Shopping MallDova shopping centre.
User — any natural or legal person who accesses, visits or uses the Website.
Content — any text, image, photograph, video material, audio material, graphic element, logo, trademark, design, structure, document, information or other material available on the Website.
Trademarks / Distinctive Signs — the name “Shopping MallDova”, the logo, visual identity elements, trade names and any other signs used by the Company.
Improper Use — any use of the Website that is contrary to the law, these Terms, standards of morality, the rights of the Company or the rights of third parties, as well as any actions that may affect the operation, security, integrity or availability of the Website.
3. Purpose of the Website
The Website is intended for informational and presentation purposes.
Through the Website, Shopping MallDova may provide users with information about:
a) the Shopping MallDova shopping centre;
b) shops, restaurants, cafés, entertainment areas and other business entities operating within the shopping centre;
c) opening hours;
d) events, campaigns, promotions or activities held at the shopping centre;
e) facilities, services and general rules applicable to visitors;
f) news, announcements, notices and other general information;
g) applications for the lease of premises.
The information published on the Website is provided for general informational purposes. Shopping MallDova makes reasonable efforts to ensure the accuracy and currency of the information published; however, it does not guarantee that all information is complete, error-free or continuously kept up to date.
4. Acceptance of the Terms
Use of the Website constitutes acceptance of these Terms.
Shopping MallDova reserves the right to amend, supplement or update this document whenever it deems necessary. The updated version will be published on the Website and will take effect from the date of publication unless another date is expressly specified.
The User is responsible for periodically reviewing the content of the Terms. Continued use of the Website after changes have been made constitutes acceptance of the updated version.
5. Intellectual Property Rights
All Content on the Website, including texts, images, photographs, video materials, graphic elements, design, structure, logos, trademarks, trade names and any other published materials, belongs to Shopping MallDova, its contractual partners or other rights holders, as applicable.
The User may access, view and print materials from the Website solely for personal, non-commercial use, subject to compliance with copyright and other intellectual property rights.
Without the prior written consent of Shopping MallDova, it is prohibited to:
a) copy, reproduce, modify, distribute, transmit, republish or sell the Content;

6. Permitted Use of the Website
The User undertakes to use the Website in good faith, in accordance with the law and these Terms, without causing harm to the rights or interests of Shopping MallDova or third parties.

a) using the Website for illegal, fraudulent, improper or harmful purposes;

Shopping MallDova reserves the right to restrict access by any user who uses the Website improperly or in violation of these Terms.
7. Information About Shops, Partners, Promotions and Events
The Website may contain information about shops, restaurants, cafés, service providers, tenants, business partners, events or campaigns held at Shopping MallDova.
This information is published for informational purposes.
The mere publication of such information on the Website does not mean that Shopping MallDova is the seller of the goods or provider of the services offered by shops, restaurants, cafés or other business entities operating within the shopping centre.
Any legal relationship relating to the purchase of goods, provision of services, price, quality, availability, warranty, returns, claims or other commercial matters is established directly between the customer and the relevant business entity.
Shopping MallDova shall not be liable for goods, services, offers, prices, promotions, product availability, commercial terms or information provided by shops, tenants or partners, except where otherwise expressly provided by law or where Shopping MallDova expressly assumes a specific obligation.
Promotions, campaigns or events promoted on the Website may be governed by specific rules. Users must review the relevant rules before participating.
8. Limitation of Liability
Shopping MallDova makes reasonable efforts to ensure the proper operation of the Website but does not guarantee uninterrupted operation or the absence of errors, delays or technical problems.
Shopping MallDova shall not be liable for:
a) errors, omissions or delays in updating information published on the Website, unless directly attributable to its fault;
b) temporary or complete unavailability of the Website for technical reasons, due to maintenance, security measures, force majeure circumstances or reasons related to service providers;
c) damage caused by the User’s improper use of the Website;
d) the content, policies, practices or security of third-party websites to which links may be provided on the Website;
e) information provided by shops, tenants, partners or other third parties;
f) indirect losses, loss of profits, loss of data, lost opportunities or other indirect damage arising from the use of or inability to use the Website, to the extent permitted by law.
Nothing in this document excludes Shopping MallDova’s liability in cases where such liability cannot be excluded or limited under applicable law.
9. Links to Third-Party Websites
The Website may contain links to websites, platforms, social media pages or services operated by third parties.
These links are provided for informational purposes or for convenience. Shopping MallDova does not control and is not responsible for the content, operation, security, privacy policies, cookie policies or practices of third parties.
Access to third-party websites is at the User’s own risk. The User is solely responsible for reviewing the terms of use, privacy policies and cookie policies of such third parties.
10. Forms, Requests and Communications Submitted Through the Website

The User is responsible for the content of the information transmitted through the Website and guarantees that it does not violate the law, the rights of Shopping MallDova or the rights of third parties.

The processing of personal data through the Website is carried out in accordance with applicable personal data protection legislation, including Law No. 133/2011 on Personal Data Protection and, from the date of its entry into force, Law No. 195/2024 on Personal Data Protection.
Where applicable, Shopping MallDova also takes into account the standards of Regulation (EU) 2016/679 on personal data protection.
Shopping MallDova may process personal data when the User:

For the administration of the Website, technical maintenance, hosting, security, communications, technical analysis or the provision of other related services, Shopping MallDova may engage service providers who, in accordance with the law, may act as data processors.
Such providers may process personal data only to the extent necessary to provide the contracted services, in accordance with Shopping MallDova’s instructions and in compliance with applicable confidentiality and security obligations.
Shopping MallDova will respond to requests concerning the exercise of data subjects’ rights without undue delay and within the period prescribed by applicable law.
In complex cases or where there is a large number of requests, the period may be extended in accordance with the law, with notification to the data subject.
If a request is submitted electronically, the response may be provided by electronic means unless the data subject requests another format.
Shopping MallDova may request additional information strictly necessary to confirm the identity of the applicant if there are reasonable doubts concerning the identity of the person submitting the request.

14. Applications for the Lease of Commercial Premises
The Website may provide the option to submit applications or enquiries regarding the lease of available commercial premises at Shopping MallDova.
Submitting such an application does not constitute a firm offer, acceptance of a contract, binding reservation, promise to enter into a lease agreement or an obligation on the part of Shopping MallDova to enter into an agreement.
Information submitted through the application form for the lease of premises will be used to review the request, contact the applicant, provide relevant information and, where necessary, initiate pre-contractual negotiations.
The applicant must provide truthful, accurate, complete and up-to-date information. Shopping MallDova reserves the right not to consider applications that are incomplete, unclear, improper or contain knowingly false information.
If an application is submitted on behalf of a legal entity, the person completing the form declares that they are authorised to provide the relevant data and information on behalf of that organisation.
The processing of personal data submitted through the application form for the lease of premises is carried out in accordance with the Privacy Policy.
15. Campaigns, Promotions and Events
Shopping MallDova may organise, conduct or promote campaigns, promotions, competitions, loyalty programmes, and cultural, commercial, community or entertainment events.
Participation in such activities may be governed by specific rules which, depending on the circumstances, establish:
a) the organiser;
b) the period and location;
c) conditions of participation;
d) eligibility criteria;
e) prizes or benefits offered;
f) applicable restrictions;
g) procedures for processing personal data;
h) procedures for submitting complaints or challenges.
Users must review the specific rules before participating in campaigns, promotions or events.
If the Website merely publishes information about events or promotions organised by third parties, responsibility for conducting them lies with the organiser identified in the relevant materials, except where Shopping MallDova is expressly identified as the organiser.

Nevertheless, neither data transmission over the Internet nor any information system can be guaranteed to be completely secure.
In the event of a personal data security breach, Shopping MallDova will act in accordance with applicable law, including notifying the competent authority and/or informing data subjects where such measures are required by law.
The User is responsible for using devices, applications, browsers and connections that are secure, up to date and protected against unauthorised access, viruses, malware and other information security risks.
17. Exonerating Circumstances
Shopping MallDova shall not be liable for failure to perform or improper performance of its obligations where caused by force majeure, unforeseen circumstances or other circumstances beyond its control.
Such circumstances may include, but are not limited to:
a) failures of communication networks;
b) cyberattacks;
c) disruptions affecting Internet providers, hosting or infrastructure;
d) actions of public authorities;
e) natural disasters;
f) fires, explosions, strikes, civil unrest, epidemics, pandemics or other similar events.

19. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Moldova.

If an amicable settlement cannot be reached, the dispute shall be submitted to the competent courts in accordance with the laws of the Republic of Moldova.
20. Final Provisions
If any provision of these Terms is found to be null and void, invalid or unenforceable, the remaining provisions shall remain valid and enforceable.
Shopping MallDova’s failure to exercise any right provided for in this document does not constitute a waiver of that right.
